En internetleverantör som publicerat offentliga uppgifter om tortyr i spanska fängelser dras nu inför rätta.- Lagen är ett perfekt instrument för makthavare att ta till när de känner behov av att tysta ner något, säger Alberto Escudero, representant för Nodo50, en spansk internetoperatör som riktar sig till personer, företag och organisationer som vill föra ut sina åsikter i samhällsdebatten. Spanien följde Sverige Den spanska dataskyddslagen började gälla i december 1999, ett drygt år efter svenska Pul som var ett av de första nationella genomförandena av EU-direktivet. Enligt Alberto Escudero är det inte en slump att Sverige var bland de första att genomföra EU-direktivet. Han ser Sverige som ett land där medborgarna i väldigt hög grad litar på staten. - Det gjorde det lättare för Spanien att följa efter. (APC alerts)Anti-Torture Website in Spain Threatened with CensureIn English/En inglesMarch 10 -- The Association against Torture (ACT), an organization reporting acts of brutality and torture in the Spanish State since 1989 has had its Website threatened with possible closure following an investigation by the Spanish Agency for Data Protection.Inspectors from the Agency for Data Protection arrived at the Nodo50 (APC member in Madrid, Spain, and hosts of the ACT Website) offices on March 8 demanding information from the ACT Website. The investigation, which is still underway, was started following an official complaint to the agency that the ACT Website publishes the names of police officers, prison warders and other state law enforcement officials accused of torture and brutality. Next to the name of each officer an indicator shows whether the officer was found guilty or was absolved of the charges made against: him or her. The Spanish newspaper, ABC,
reported today that "(Fernandez) explained that no-one, except for the
appropriate public bodies (…) can store information regarding criminal
or administrative offences ( ..) even court reports identify those implicated
by their initials". ABC, which had obtained information denied to ACT and
Nodo50, would appear to be building a case for criminalization of the ACT
Website. Nodo50 reports that this newspaper has previously been instrumental
in influencing public sentiment prior to a police or judicial intervention
in similar cases.

Mit Hilfe des Datenschutzgesetzes soll die Asociación contra la Tortura (ACT) - Anti-Folter-Gesellschaft - zum Schweigen gebracht werden. Mit der Veröffentlichung der Listen von Polizeibeamten, die sich wegen Misshandlung und Folter vor dem Kadi verantworten müssen, im Internet (www.nodo50.org/actortura/) verletze die hauptsächlich aus Anwälten bestehende ACT die Privatsphäre, meint der Datenschutzbeauftragte (www.ag-protecciondatos.es), der jetzt ein Verfahren eröffnet hat. Sollte die ACT schuldig gesprochen werden, droht eine Strafe zwischen 10 und 50 Millionen Peseten - 120.000 bis 600.000 Mark.Damit nicht genug. Auch dem Provider werden strafrechtliche Maßnahmen angedroht, falls er die Seite der ACT nicht unverzüglich schließt. Nodo50 ist ein Verbund verschiedener Nichtregierungsorganisationen, der seit der Tagung des Internationalen Währungsfonds (IWF) 1994 in Madrid in Zusammenarbeit mit der Agency for Progressive Communications (APC, www.apc.org) in Spanien unterschlagene Nachrichten aus dem Bereich Menschenrechte, Umweltschutz und Solidaritätsbewegung verbreitet. Statt die Seite zu schließen, hat ACT Widerspruch eingelegt. "Die fraglichen Daten sind nicht als privat anzusehen, da sie von den Gerichten der Öffentlichkeit zugänglich gemacht werden", verteidigt sich der ACT-Vorsitzende Jorge del Cura, der die Jahresberichte seiner Menschenrechtsgruppe jedes Mal nach erscheinen sowohl dem Innen- als auch dem Justizministerium zusendet. Vor allem der letzte Bericht über das Jahr 1998 sorgte für großes Aufsehen in der spanischen Presse, konnte die ACT doch aufzeigen, dass im Berichtszeitraum täglich mindestens eine Anzeige wegen Misshandlung oder Folter an Verhafteten und Gefangenen erstattet wurde. Anstatt diese Informationen zu unterdrücken, hat das spanische Innenministerium genau das Gegenteil erreicht.
